Kathryn Scott, Gaby Hardwicke Solicitors - “Laura Buchan has quickly become my “go-to” barrister for both Private Law and Financial Remedy cases. Wonderful to work with, she is friendly, approachable and impeccably prepared, providing sensible and well thought-out advice to clients who appreciate her ability to blend realism with compassion. In Court she is a persuasive advocate, well-informed and fast on her feet when needed. She provides excellent value for money.”
Seema Roberts, Brighton & Hove Law – “I have always been very pleased with Laura’s representation for my clients in Financial and Private Law Children proceedings. She is always thorough in her preparation, she has a no-nonsense approach and the clients find her very personable. I would not hesitate to instruct her in children proceedings or financial cases.”
Sarah Griffin, Children’s Guardian, CAFCASS – “The first time Laura was instructed to represent me and the children was at short notice in a public law case. I was very impressed by Laura’s preparation, knowledge and understanding of the case and her commitment to ensure the Children were advocated for and their interests represented.
Laura is now my “go – to” Barrister when instructing counsel, and I feel both the Children and I are in very safe hands when Laura is representing us. I always feel supported by Laura’s professional advice and her willingness to discuss cases with me and she explains the relevant law and analyses the likely arguments to be made by other parties.
I have now worked with Laura for over 16 months on a variety of very complex cases and Laura’s advocacy skills are impeccable as is her dedication, preparation and commitment. I often conclude a hearing with the right outcome for the child due to Laura ensuring the child’s voice is heard and decisions made in their best interests.”
Laura has a busy practice, accepting instructions in all areas of Family law. Laura also enjoys advising, making and opposing costs applications in her areas of practice.
Laura is regularly instructed within financial remedy proceedings. She has experience in successfully running conduct, dissipation of assets and applications for freezing injunctions.
She is often instructed to advise on matters involving both needs and large asset cases. These often include pensions, companies, applications for maintenance pending suit and consideration of passive/active growth. Laura is constantly updating her practice knowledge and has an understanding on how cryptocurrency is considered within financial remedy proceedings.
Her practice extends to Schedule 1 of Children Act 1989.
Children (Private Law)
Laura frequently represents parents in private law proceedings, including matters with complex issues of relocation, parental alienation, serious domestic abuse allegations, change of residence and the involvement of 16.4 Guardians.
Following rigorous cross examination of CAFCASS/16.4 Guardians she has successfully obtained orders on behalf of a parent that was more beneficial than the professional recommendations.
Laura has recently provided training to newly qualified social workers from East Sussex County Council on how to properly prepare well informed and compliant section 7 reports.
Family Law Act applications
Laura has extensive experience in representing parties involved in injunction proceedings for non-molestation orders and occupation orders. She has recently successfully opposed the making of an occupation order, considered to be a ‘backdoor’ financial remedy application.
Children (Public Law)
In Public Law, Laura is often instructed to act for the child, through their Guardian.
Laura is instructed by Guardians to undertake complicated cases, including lengthy fact-finding hearings and welfare hearings with numerous experts giving evidence. She has also dealt with DOLs and disclosure applications in the High Court on behalf of the child.
Laura is also instructed to represent parents. She has a wealth of experience in representing vulnerable parents with learning difficulties, substance misuse and mental health difficulties.
An example of Laura representing a Mother in public law proceedings in an 8 day final hearing, where professionals sought to place the child under a Special Guardianship Order. She fiercely challenged the evidence on behalf of her client, which resulted in the child transitioning to the Mother’s care in time for Christmas, following over a year in long term foster care.
Laura prides herself on her ability to be affable and professional with her clients. She believes it is important to actively communicate with Instructing Solicitors and work collaboratively to ensure the best representation of a client.
