In these proceedings, the applicants, A and B, a same sex married couple, entered into a surrogacy agreement with the respondents, the surrogate and her husband, who lived in Minnesota, USA, in April 2024. The respondents had independent legal advice and assistance throughout the process and the agreement provided for permitted payments for expenses. The embryo was placed in September 2024 and the subject child was born in May 2025.
