Neive Augustin
Barrister
Neive accepts instructions across a wide spectrum of Chambers’ specialist areas within Family and Civil law.
Neive acts in all aspects of private family law with a focus on financial remedies (including Schedule 1 claims), private children work, and protective injunction applications under FLA 1996. She has successfully represented clients in matrimonial finance proceedings, handling matters from the initial stages through to final hearings, and specifically welcomes work in this area. She also regularly represents clients at court in small claims and fast-track hearings.
Nieve is a compelling advocate whose approach is defined by a strong sense of empathy.
She places great value on helping a client fully understand their options and her approach is centred on making sure clients have a clear understanding of the possible outcomes.
Family Finance:
Neive has extensive experience in all areas of family finance, including division of assets on divorce, Schedule 1 claims, spousal maintenance, enforcing financial orders, and other ancillary relief matters and financial disputes arising from family law. She is expanding her practice in TOLATA (Trusts of Land and Appointment of Trustees Act) claims.
Prior to coming to the bar, Neive worked in accounting which has left her with a keen eye for forensic detail. She understands that financial disputes within the context of family law are both highly sensitive and hugely personal so prides herself on her ability to work with her clients to ensure that their interests are protected. She takes a pragmatic approach to her work, whether she is providing comprehensive advice before proceedings or when a financial settlement is being sought. She works with her clients to achieve an agreed order whenever possible.
Private Law (Child Arrangements Programme (CAP)):
Neive has developed a broad private child base. She understands the particular impact that barristers can often have on private child matters, dealing not only with the practical, legal aspects of a situation, but also acting as an advocate, and providing essential support in high-conflict parenting cases.
She provides robust support to her clients, including disputes over who the child lives with and contact arrangements. Neive also works with vulnerable clients including cases where there are allegations and victims of domestic abuse including controlling and coercive behaviour. She has experience representing parents and guardians throughout every stage of proceedings from the First Hearing Dispute Resolution Appointment through to the final hearings including fact-finding hearings.
Neive fully appreciates the emotional impact of the support she provides and ensures that the best interests of the child always remain the priority.
Protective Injunctions (Family Law Act 1996 Applications):
In respect of FLA 1996 applications, Neive is regularly brought in for her experience with complex or non-standard legal issues in relation to non-molestation orders. This is complemented by her added specialism in dealing with occupation orders which provides clients with continuity of counsel. She places great value on helping a client experiencing domestic abuse who needs to protect themselves and their children. This empathetic approach is at the heart of her practice.
Civil:
Neive has quickly developed a busy civil practice. She is known for her excellent representation and drafting work in small claims and fast-track claims and especially welcomes instructions in money claims and property possession, including tenancy deposit claims, assessing merits and valuing repairs and homelessness.
